SUMMIT BREWING CO. MINNESOTA STATE FAIR FAMILY 4-PACK TICKET GIVEAWAY

ELIGIBILITY: The Summit Brewing Co. Minnesota State Fair Family 4-Pack Ticket Giveaway Sweepstakes (the “Sweepstakes”) is open to legal residents of the state of Iowa, Minnesota, North Dakota, South Dakota and Wisconsin (the “Territory”) who are twenty-one (21) years of age and older at the time of entry. The Sweepstakes is subject to all applicable federal, state and local laws, rules and regulations. Void outside of Territory, and where prohibited or restricted by law, rule or regulation. The Sweepstakes is in no way sponsored or endorsed by the Minnesota State Fair (“MN State Fair”).

Employees, officers, and directors, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household (whether or not related), of Summit Brewing Company (“Sponsor”), MN State Fair, each of their affiliates, subsidiaries and related entities, board of directors, shareholders, advertising and promotion agencies, wholesale distributors, retail partners and all other service agencies involved with the Sweepstakes, are not eligible to participate in the Sweepstakes or win any prize. Any Sweepstakes entries received from an ineligible participant will be disqualified.

SPONSOR: The Sweepstakes is sponsored by Summit Brewing Company, 910 Montreal Circle, Saint Paul, MN 55102.

AGREEMENT TO OFFICIAL RULES: By participating in this Sweepstakes, participants warrant that they meet the eligibility requirements and accept and agree to be bound by these rules and the decisions of the Sponsor, which shall be final on all matters. Sponsor reserves the right to modify the rules of the Sweepstakes in any way at any time, subject to state and federal law. Winning the Prize is contingent upon fulfilling all requirements as set forth herein.

ENTRY PERIOD: The Sweepstakes begins on July 1, 2023, at 12:00 a.m. Central Time (“CT”) and ends on July 31, 2023, at 11:59 p.m. CT (“Entry Period”). The clock of the Sponsor computer system will be the official time-keeping device for this Sweepstakes. All entries must be received and recorded by Sponsor during the Entry Period to be eligible.

METHOD OF ENTRY: During the Entry Period, there are two (2) possible way to enter. No other method of entry will be accepted.

QR CODE: During the Entry Period, use your smart phone or other web-enabled device with data plan to scan the Sweepstakes quick response (“QR”) code featured on signs or promotional materials at select participating stores/retail locations with the QR reader application already installed on your phone. You will be directed to the Sponsor’s Sweepstakes Online Entry Form (the “Entry Page”) where you are required to complete and submit your information to be entered for your chance to win the Sweepstakes.
SOCIAL MEDIA: During the Entry Period, use your smart phone or computer to view select social media advertisements/posts endorsed and officially approved by the Sponsor that include the official “Summit Brewing Company Minnesota State Fair Family 4-Pack Ticket Giveaway” Sweepstakes image, information and associated link. Either click the link or type in the URL in a web browser and you will be directed to a specific Sponsor’s Sweepstakes Entry Page where you are required to complete and submit your information to be entered for your chance to win the Sweepstakes.

Participants are limited to one (1) entry per person regardless of method of entry. Multiple entries received from any one person using different methods of entry or e-mail addresses or phone numbers to gain multiple entries in sweepstakes will be void. Entrants must fully complete and/or submit all non-optional data requested to be eligible. Incomplete entries are void. All information submitted will be subject to use by only Summit Brewing Company for its own marketing and advertising related initiatives. Opting in or out to receive such marketing messages from Summit Brewing Company during the Entry Period will not increase or decrease your chances of winning.

Data rates may apply. The Sponsor will never borrow, sell or rent your information to any other person, company or organization. Consent is not required to buy goods or services.

RANDOM DRAWING; ODDS: One (1) potential winner will be selected by random drawing from among all eligible entries received. The random drawing will occur no later than three (3) days following the end of the Entry Period. Subject to verification of eligibility and compliance with these Official Rules, the potential winners will be declared the official winners of the Sweepstakes. The decisions of Sponsor are final and binding on all matters related to this Sweepstakes. Odds of winning depend on the total number of eligible entries received during the Entry Period.

PRIZE: A total of one (1) prize will be awarded. Each winner will receive admission tickets to the 2023 MN State Fair (the “Prize”), consisting of four (4) general admission tickets.

Each winner is fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes). All costs and expenses associated with prize acceptance and use not specified herein as being provided, including but not limited to, any shipping or travel fees/expenses, and any other expenses incurred by accepting the Prize are the sole responsibility of the winner. The Prize details are at Sponsor’s sole discretion.

Approximate Retail Value (the “ARV”) of the Prize: $72.00. No cash value. Prize will be awarded “as is” with no warranty or guarantee, either express or implied offered by Sponsor.

The Prize is non-transferable and non-assignable, with no cash value redemptions or substitutions except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute the Prize (or portion thereof) with one of comparable value, at its sole and absolute discretion. If the final Prize value is under stated ARV, no cash reimbursements or prize alterations will be made.

The dates and times of the fair are determined in the sole discretion of the MN State Fair, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as part of the Prize will govern in the event the fair, as defined by MN State Fair, is not held due to weather, an Act of God, an act of terrorism, civil disturbance, work stoppage or any other reason. Winner and his/her guest agree to comply with all applicable MN State Fair regulations in connection with the Prize. Sponsor, or MN State Fair, reserve the right to remove or deny entry to winner and/or his/her guest who engage in any non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at any game or event. Release Parties (as defined below) will not be responsible for weather, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other event that may cause the cancellation or postponement of any MN State Fair, event or exhibition.

Sponsor will work with verified winners to schedule a mutually agreed upon delivery date of the Prize elements within three (3) days after the end of the Entry Period and prize acceptance.

NOTIFICATION: The potential winner must continue to comply with the Official Rules. Winning is contingent upon fulfilling all requirements. The winners will be notified by e-mail, text message, social media message and/or telephone call/message, at the sole discretion of Sponsor, by the Sponsor. The winners selected will be notified by e-mail within three (3) business days of the drawing. In the event that any winner does not respond to any such notification within thirty-six (36) hours of the date and time of first notification indicating whether he/she can accept the Prize, or if the prize notification is returned as unclaimed or undeliverable to potential winner, a disqualification will result, the Prize will be forfeited and, at Sponsor’s sole discretion and time permitting, an alternate winner may be chosen from among all remaining eligible entries. Any alternate potential winner selected will also be required to respond to the notification within three (3) days of the date and time of notification. There will be only one (1) potential alternate drawing to the initial drawing, should Sponsor choose to do so at its sole discretion, after which the Prize will remain un-awarded.

WAIVER OF LIABILITY/PUBLICITY RELEASE: By entering the Sweepstakes, each entrant agrees to (i) be bound by these Official Rules, including all entry requirements, and (ii) waive any and all claims or causes of action against the Sponsor, MN State Fair, and each of their respective parent companies, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, retail partners and any other company involved with the design, production, execution or distribution of this Sweepstakes, and all of their respective officers, directors, agents and representatives (collectively, “Released Parties”) for any injury, damage, or loss that may occur, directly or indirectly, in whole or in part, from participation in the Sweepstakes or receipt or use of the Prize (or any portion thereof), or any travel or activity related thereto. Each winner, by acceptance of the Prize, grants to Sponsor and each of its respective designees the right to publicize such winner’s name, address, city and state of residence, photograph, voice and/or other likeness and prize information in any and all media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, unless prohibited by law.

GENERAL CONDITIONS: The decisions of Sponsor are final and binding on all matters relating to the Sweepstakes. Released Parties are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, scrambled, damaged, delayed, undelivered, mutilated, postage-due, or garbled entries via e-mail or mail, lost, interrupted or unavailable network, server, Internet Service Provider (“ISP”), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the Prize(s) or in any Sweepstakes-related materials or cancellation or postponement of MN State Fair game/event/exhibition or ticket delivery. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to entrants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of a website. Each winner must satisfactorily complete an affidavit of eligibility, unless prohibited by law, showing compliance with these Sweepstakes rules and each winner must also sign a liability and publicity release allowing Sponsor to use his/her/their information for advertising or other purposes and returned to Sponsor within three (3) days of prize acceptance. Failure to complete these forms may result in forfeiture of the Prize. Subject to verification of eligibility and compliance with the terms of these Official Rules, including verification that the winner is/was twenty-one (21) years of age or older at the time of entry, the potential winner will be declared an official winner of the Sweepstakes. If Sponsor cannot verify that the potential winner is twenty-one (21) years of age or older at the time of entry and lives in the Territory prior to winner notification, then the potential winner will be disqualified and an alternate potential winner may be selected in Sponsor’s sole discretion. In the event that the potential winner is disqualified for any reason, Sponsor may select an alternate potential winner by random drawing from among all remaining eligible entries. Sponsor will only choose an alternate potential winner one time following an initial forfeited Prize.

Sponsor is not responsible for suspended or discontinued Internet, wireless, or land-line phone service, non-receipt of notification by potential winner due to any electronic communication delay or delivery failure, or a change in an entrant’s email, phone number or mailing address which may result in a potential winner not receiving initial prize notification or his/her/their prize information.

LIMITATION OF LIABILITY/DISPUTE RESOLUTION: By entering the Sweepstakes, entrants release Sponsor, MN State Fair and any affiliated companies, directors, officers, employees, representatives, partners, and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or with the acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses, or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light).

Except where prohibited, each participant and winner accepting a prize agrees that: (a) all issues and questions concerning these rules shall be governed by Minnesota law without giving effect to any principles of conflicts of law of any jurisdiction; (b) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Sweepstakes or any prize awarded shall be (i) resolved individually, without resort to any form of class action; and (ii) filed only in the state courts situated in Minnesota, and participant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall include attorneys’ fees; and (d) under no circumstances will any participant or winner be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

Entries generated by a script, macro or other mechanical or automated means or by any means that subvert the entry process will be disqualified. Any entries submitted due to any unauthorized online websites or social channels that posted or shared this Sweepstakes without express written permission from the Sponsor will be disqualified, as posting or sharing of this Sweepstakes in any form, printed or digital, on any online source or social channel without express written permission from the Sponsor is strictly prohibited. Persons who tamper with or abuse any aspect of the Sweepstakes, text messaging platform or website or attempt to undermine the legitimate operation of the Sweepstakes by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor and/or their respective agents. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaim any implied warranty.

The Sponsor, as applicable, reserves the right, in their sole discretion, to cancel or suspend the Sweepstakes for any reason, including should virus, bugs, unauthorized human intervention, or other causes corrupt the administration, security, fairness, integrity or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify the winner(s) and award the Prize(s) by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.

The potential winner is subject to verification by Sponsor. Potential winner will be required to show proof of identity. Sponsor will not accept screenshots or other evidence in lieu of its validation process.

PRIVACY AND USE OF SWEEPSTAKES INFORMATION: Sponsor may collect personal information from you when you enter the Sweepstakes. Sponsor reserves the right to use any information collected in accordance with the Official Rules as well as its Privacy Policy, which may be found at https://www.summitbrewing.com/privacy-policy/. If you are verified as a prize winner, your first name, last initial, city and state will be included in a publicly available winner list.

WINNER’S LIST: For the winner’s list, send an e-mail to [email protected] and include “Summit Brewing Co. & Minnesota State Fair Family 4-Pack Ticket Winner’s List Request” in the subject line. All winner’s list requests must be received by Sponsor before September 15, 2023. Winner’s list to be available after August 25, 2023.
