Posting or sharing of this Sweepstakes in any form on any online source or social channel without express written permission from the Sponsor is strictly prohibited.

OFFICIAL RULES

MN TWINS STAYCATION EXPERIENCE
WITH SUMMIT BREWING COMPANY SWEEPSTAKES #MNTWINSSTAYCATION

1.NO PURCHASE NECESSARY TO WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS SWEEPSTAKES IS INTENDED FOR VIEWING IN MINNESOTA, NORTH DAKOTA, SOUTH DAKOTA, IOWA AND WISCONSIN ONLY. VOID WHERE PROHIBITED BY LAW. TRAVEL NOT INCLUDED.

2. ELIGIBILITY: The Minnesota Twins Staycation Experience with Summit Brewing Company Sweepstakes (the “Sweepstakes”) is open to legal residents of the state of Minnesota, Wisconsin, Iowa, South Dakota and North Dakota (the “Territory”) who are twenty-one (21) years of age and older at the time of entry. The Sweepstakes is subject to all applicable federal, state and local laws, rules and regulations. Void outside of Territory, and where prohibited or restricted by law, rule or regulation.

3. INELIGIBLE PARTICIPANTS. Employees, officers, and directors, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household (whether or not related), of Summit Brewing Company (“Sponsor”), Minnesota Twins, LLC (“Minnesota Twins”), the other MLB Entities, each of their affiliates, subsidiaries and related entities, board of directors, shareholders, advertising and promotion agencies, wholesale distributors, retail partners and all other service agencies involved with the Sweepstakes, are not eligible to participate in the Sweepstakes or win any prize. “MLB Entities” means the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. (“MLB”), Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated, and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees, and agents of the foregoing entities. Any Sweepstakes entries received from an ineligible participant will be disqualified.

4. SPONSOR: The Sweepstakes is sponsored by Summit Brewing Company, 910 Montreal Circle, Saint Paul, MN 55102.

5. AGREEMENT TO OFFICIAL RULES: By participating in this Sweepstakes, participants warrant that they meet the eligibility requirements and accept and agree to be bound by these rules and the decisions of the Sponsor, which shall be final on all matters. Sponsor reserves the right to modify the rules of the Sweepstakes in any way at any time, subject to state and federal law. Winning the Prize is contingent upon fulfilling all requirements as set forth herein.

6. ENTRY PERIOD: The Sweepstakes begins on Wednesday, May 1, 2024, at 6:50 p.m. Central Time (“CT”) and ends on Sunday, June 30, 2024, at 11:59 p.m. CT (“Entry Period”). The clock of the Sponsor computer system will be the official time-keeping device for this Sweepstakes. All entries must be received and recorded by Sponsor during the Entry Period to be eligible.

7. METHOD OF ENTRY: During the Entry Period, there are three (3) possible ways to enter. No other method of entry will be accepted.

    • QR CODE: During the Entry Period, use your smart phone or other web-enabled device with data plan to scan the Sweepstakes quick response (“QR”) code featured on signs or promotional materials at participating stores/retail locations with the QR reader application already installed on your phone. You will be directed to the Sponsor’s Sweepstakes Online Entry Form (the “Entry Page”) where you are required to complete and submit your information to be entered for your chance to win the Sweepstakes.
    • SOCIAL MEDIA: During the Entry Period, use your smart phone, computer or other web- enabled device to view select social media advertisements/posts endorsed and officially approved by the Sponsor that include the official “MN Twins Staycation Experience with Summit Brewing Company” Sweepstakes image, information and associated link. Either click the link or type in the URL in a web browser and you will be directed to the Entry Page where you are required to complete and submit your information to be entered for your chance to win the Sweepstakes.
    • ELECTRONIC NEWSLETTER / WEBPAGE: During the Entry Period, use your mobile phone, computer or other web-enabled device to view select digital newsletter(s) or webpage(s) endorsed and officially approved by the Sponsor that include the official “MN Twins Staycation Experience with Summit Brewing Company” Sweepstakes image, information and associated link. Either click the link or type the URL in a web browser and you will be directed to the Entry Page where you are required to complete and submit your information to be entered for your chance to win the Sweepstakes.

8. ENTRY LIMITS. Participants are limited to one (1) entry per person regardless of method of entry. Multiple entries received from any one person using different methods of entry or e- mail addresses or phone numbers to gain multiple entries in sweepstakes will be void.

9. DATA REQUESTS. Entrants must fully complete and/or submit all non-optional data requested to be eligible. Incomplete entries are void. All information submitted will be subject to use by only Sponsor for its own marketing and advertising related initiatives. Opting in or out to receive such marketing messages from Sponsor during the Entry Period will not increase or decrease your chances of winning. Data rates may apply. The Sponsor will never borrow, sell or rent your information to any other person, company or organization. Consent is not required to buy goods or services.

10. RANDOM DRAWING; ODDS: Two (2) potential winners will be selected by random drawing from among all eligible entries received. The random drawing will occur no later than eight (8) days following the end of the Entry Period. Subject to verification of eligibility and compliance with these Official Rules, the potential winners will be declared the official winners of the Sweepstakes. The decision of Sponsor is final and binding on all matters related to this Sweepstakes. Odds of winning depend on the total number of eligible entries received during the Entry Period.

11. PRIZE: A total of two (2) prizes (each, a “Prize”) will be awarded:

I. One (1) winner will receive a MN Twins Staycation Experience with Summit Brewing Co. prize pack, consisting of:

  • Four (4) tickets for winner and three (3) guests to two (2) Minnesota Twins home games

II. on Saturday, July 20, 2024, and Sunday, July 21, 2024

  • One (1) standard hotel room for winner and three (3) guests at The Lofton Hotel Minneapolis Hotel on Saturday, July 20, 2024, and Sunday, July 21, 2024
  • $200 gift card for a local restaurant
    One (1) winner will receive a MN Twins Staycation Experience with Summit Brewing Co. prize pack, consisting of:
  • Four (4) tickets for winner and three (3) guests to two (2) Minnesota Twins home games on Saturday, August 3, 2024, and Sunday, August 4, 2024
  • One (1) standard hotel room for winner and three (3) guests at The Lofton Hotel Minneapolis Hotel on Saturday, August 3, 2024, and Sunday, August 4, 2024
  • $200 gift card for a local restaurant. Each winner is fully responsible for transportation to and from The Lofton Hotel Minneapolis and the Stadium. Each winner and their guests are solely responsible for all other expenses not specifically set forth herein, including but not limited to, surcharges, service charges, personal charges, security fees, shipping and handling, taxes, transportation (ground and airfare), travel and other insurance, souvenirs and other incidentals and items of a personal nature. DO NOT ENTER THE SWEEPSTAKES IF YOU ARE NOT PREPARED TO PAY FOR TRAVEL TO/FROM THE EVENT.

12. TICKET TERMS AND CONDITIONS. Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see www.twinsbaseball.com/ticketback for details. Seat locations at the game/event/exhibition and, unless otherwise stated in the prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. Each winner’s guest(s) must be of legal age of majority in their jurisdiction(s) of residence unless accompanied by a parent or legal guardian. Major League Baseball game/event/exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets awarded as part of the Prize will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Each winner and their guest(s) agree to comply with all applicable ballpark and venue regulations in connection with the Prize; see www.twinsbaseball.com/ballpark for details. Sponsor and the MLB Entities reserve the right to remove or to deny entry to a winner and/or their guest(s) who engage in a non- sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Released Parties (as defined below) will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Major League Baseball game/event/exhibition. Major League Baseball game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture, and may invalidate the license granted by the game/event/exhibition ticket.

13. TAXES. Each winner is fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes). All costs and expenses associated with Prize acceptance and use not specified herein as being provided, including but not limited to, any ground transportation costs, luggage fees, meals, gratuities, apparel and any other expenses incurred by accepting the Prize are the sole responsibility of each winner. The Prize details are at Sponsor’s sole discretion.

14. PRIZE VALUE. Approximate Retail Value (the “ARV”) of each Prize: $1,500.00. Prize will be awarded “as is” with no warranty or guarantee, either express or implied offered by Sponsor.

15. ASSIGNMENT; PRIZE SUBSTITUTION. By accepting the Prize, each winner agrees to abide by any terms, conditions and restrictions provided by the tickets. The Prize is non-transferable and non-assignable, with no cash value redemptions or substitutions except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute the Prize (or portion thereof) with one of comparable value, at its sole and absolute discretion. If the final Prize value is under stated ARV, no cash reimbursements or prize alterations will be made.

16. NOTIFICATION: Potential winners must continue to comply with the Official Rules. Winning is contingent upon fulfilling all requirements. The winners will be notified by e-mail, text message and/or telephone call/message, at the sole discretion of Sponsor, by the Sponsor. The winners selected will be notified by e-mail within five (5) business days of the drawing. In the event that any winner does not respond to any such notification within seventy-two (72) hours of the date and time of first notification indicating whether he/she can accept the Prize, or if the prize notification is returned as unclaimed or undeliverable to a potential winner, a disqualification will result, the Prize will be forfeited and, at Sponsor’s sole discretion and time permitting, an alternate winner may be chosen from among all remaining eligible entries. Any alternate potential winner selected will also be required to respond to the notification within seventy-two (72) hours of the date and time of notification. There will be only one (1) potential alternate drawing to the initial drawing, should Sponsor choose to do so at its sole discretion, after which the Prize will remain un- awarded.

17. WAIVER OF LIABILITY/PUBLICITY RELEASE: By entering the Sweepstakes, each entrant agrees to (i) be bound by these Official Rules, including all entry requirements, and (ii) waive any and all claims or causes of action against the Sponsor, Minnesota Twins, the other MLB Entities, the Stadium and each of their respective parent companies, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, retail partners and any other company involved with the design, production, execution or distribution of this Sweepstakes, and all of their respective officers, directors, agents and representatives (collectively, “Released Parties”) for any injury, damage, or loss that may occur, directly or indirectly, in whole or in part, from participation in the Sweepstakes or receipt or use of the Prize (or any portion thereof), or any travel or activity related thereto. Each winner, by acceptance of the Prize, grants to Sponsor and each of its respective designees the right to publicize such winner’s name, address, city and state of residence, photograph, voice and/or other likeness and prize information in any and all media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, unless prohibited by law.

18. GENERAL CONDITIONS: The decisions of Sponsor are final and binding on all matters relating to the Sweepstakes. Released Parties are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, scrambled, damaged, delayed, undelivered, mutilated, postage-due, or garbled entries via e-mail or mail, lost, interrupted or unavailable network, server, Internet Service Provider (“ISP”), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the Prize(s) or in any Sweepstakes-related materials, or cancellation or postponement of any Major League Baseball game/event/exhibition or game ticket delivery. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to entrants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of a website. Each winner must satisfactorily complete an affidavit of eligibility, unless prohibited by law, showing compliance with these Official Rules and each winner must also sign a liability and publicity release allowing Sponsor to use his or her information for advertising or other purposes and returned to Sponsor within five (5) days of Prize acceptance. Failure to complete these forms may result in forfeiture of the Prize. Subject to verification of eligibility and compliance with the terms of these Official Rules, including verification that a winner is/was twenty-one (21) years of age or older at the time of entry, a potential winner will be declared an official winner of the Sweepstakes. If Sponsor cannot verify that a potential winner is twenty-one (21) years of age or older at the time of entry and lives in the Territory prior to winner notification, then such potential winner will be disqualified and an alternate potential winner may be selected in Sponsor’s sole discretion. In the event that a potential winner is disqualified for any reason, Sponsor may select an alternate potential winner by random drawing from among all remaining eligible entries. Sponsor will only choose an alternate potential winner one time following an initial forfeited Prize.

19. WINNER COMMUNICATION REQUIREMENTS. Sponsor is not responsible for suspended or discontinued Internet, wireless, or land-line phone service, non-receipt of notification by potential winner due to any electronic communication delay or delivery failure, or a change in an entrant’s email, phone number or mailing address which may result in a potential winner not receiving initial prize notification or their prize information.

20. LIMITATION OF LIABILITY/DISPUTE RESOLUTION: By entering the Sweepstakes, entrants release Sponsor, Minnesota Twins, the other MLB Entities, the Stadium and any affiliated companies, directors, officers, employees, representatives, partners, and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or with the acceptance, possession, or use of any Prize (including, without limitation, claims, costs, injuries, losses, or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light).

21. GOVERNING LAW; LEGAL CLAIMS. Except where prohibited, each participant and winner accepting a Prize agrees that: (a) all issues and questions concerning these rules shall be governed by Minnesota law without giving effect to any principles of conflicts of law of any jurisdiction; (b) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Sweepstakes or any Prize awarded shall be (i) resolved individually, without resort to any form of class action; and (ii) filed only in the state courts situated in Minnesota, and participant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall include attorneys’ fees; and (d) under no circumstances will any participant or winner be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

22. NO UNAUTHORIZED ENTRIES. Entries generated by a script, macro or other mechanical or automated means or by any means that subvert the entry process will be disqualified. Any entries submitted due to any unauthorized online websites or social channels that posted or shared this Sweepstakes without express written permission from the Sponsor will be disqualified, as posting or sharing of this Sweepstakes in any form, printed or digital, on any online source or social channel without express written permission from the Sponsor is strictly prohibited. Persons who tamper with or abuse any aspect of the Sweepstakes, text messaging platform or website or attempt to undermine the legitimate operation of the Sweepstakes by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor and/or their respective agents. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any Prize, and (ii) disclaim any implied warranty.

23. CANCELLATION. The Sponsor, as applicable, reserves the right, in their sole discretion, to cancel or suspend the Sweepstakes for any reason, including should virus, bugs, unauthorized human intervention, or other causes corrupt the administration, security, fairness, integrity or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify the winners and award the Prizes by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation.

24. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

25. MODIFICATIONS. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.

26. WINNER VERIFICATION. Each potential winner is subject to verification by Sponsor. Each potential winner will be required to show proof of identity. Sponsor will not accept screenshots or other evidence in lieu of its validation process.

27. PRIVACY AND USE OF SWEEPSTAKES INFORMATION: Sponsor may collect personal information from you when you enter the Sweepstakes. Sponsor reserves the right to use any information collected in accordance with the Official Rules as well as its Privacy Policy, which may be found at https://www.summitbrewing.com/privacy-policy/. If you are verified as a prize winner, your first name, last initial, city and state will be included in a publicly available winner list.

28. WINNERS LIST: For the winners list, send an e-mail to [email protected] and include “2024 MN Twins Staycation Experience Sweepstakes Winners List Request” in the subject line. All winners list requests must be received by Sponsor before Tuesday July 30, 2024. Winners list to be available after Wednesday July 31, 2024.

29. DISCLAIMER OF AFFILIATION: This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with the Minnesota Twins, the other MLB Entities, the Stadium or their applicable affiliates/organizations, as well as JotForm, Instagram, Facebook or X. You understand that you are providing your information to Sponsor and not to the Minnesota Twins, the other MLB Entities, the Stadium, their applicable affiliates and organizations, or Instagram, Facebook or X. Any questions, comments or complaints regarding this Sweepstakes shall be directed only to the Sponsor and not to the Minnesota Twins, the other MLB Entities, the Stadium or their applicable affiliates, retailers, wholesalers, any other’s digital platforms, JotForm, Constant Contact, Instagram, Facebook or X or any other organization or affiliate of the aforementioned that is not explicitly listed here.

30. TRADEMARKS: Any third-party trademarks mentioned herein are the property of their respective trademark owners. The use or mention of such third-party trademarks in these Official Rules or in the Sweepstakes is solely for descriptive purposes and shall in no way imply an endorsement or sponsorship of the Sweepstakes. You are providing your information to the Sponsor and the information you provide will only be used in accordance with the Official Rules of this Sweepstakes.
